This privacy policy applies to all contacts outside the organization of Allimex. Specifically, it concerns contact persons of suppliers, third parties, customers and the like. We always process your personal data in accordance with the applicable legal provisions for the protection of personal data, including Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter the “GDPR”), and the applicable national implementing legislation.

 

2. Some concepts explained

For the purposes of this privacy policy, “personal data” means: any information relating to an identified or identifiable natural person (the “data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. In other words: all information on the basis of which a person can be identified. This includes, for example, your surname, first name, date of birth, telephone number and e-mail address, but also your IP address.

The concept of “processing” is very broad and covers, among other things, the collection, recording, organization, storage, updating, modification, retrieval, consultation, use, disclosure, combination, archiving and deletion of data.

 

3. Controller for the processing of your personal data (“data controller”)

Allimex BV is responsible for the processing of your personal data.

We are, as the GDPR calls it, the “controller” of your personal data. This means in practice that Allimex BV, possibly together with others, determines the purposes and means for the processing of your personal data.

We do not intend to collect personal data from persons under the age of 16. Such minors may not provide us with personal data or give a declaration of consent without the consent of the person who has parental responsibility.

 

4. Which personal data do we process, why and on what basis?

The table below shows:

  • Column 1: which categories of personal data we process;
  • Column 2: why we do this (the “purposes”); and
  • Column 3: on which legal basis the processing is based; and
  • Column 4: how long we process your personal data.

Each processing activity of your personal data takes place for one or more specific purposes.

In addition, there is always a demonstrable legal basis for each processing. The applicable legal basis, which you can find in the third column “legal basis”, has the following meaning:

  • “Consent”: you have given consent for the processing of personal data for one or more specific purposes;
  • “Contract”: the processing is necessary for the performance of a contract to which you are a party;
  • “Legal obligation”: the processing is necessary to comply with a legal obligation to which we are subject as controller;
  • “Legitimate interest”: the processing is necessary for the purposes of our legitimate interests or those of a third party, except where your interests or fundamental rights and freedoms which require protection of personal data override those interests.

6. Your privacy rights

To give you more control over the processing of your personal data, you have a number of rights. These rights are described, among others, in Articles 15 to 22 of the GDPR.

I. Right of access to the personal data we process about you (Art. 15 GDPR)

You have the right to know at any time whether or not we process personal data about you. If we do, you have the right to access that personal data and to obtain additional information about:

a) the purposes of the processing;

b) the categories of personal data concerned;

c) the recipients or categories of recipients (in particular recipients in third countries);

d) the storage period or, if this is not possible, the criteria used to determine that period;

e) the existence of your privacy rights;

f) the right to lodge a complaint with the supervisory authority;

g) the source of the personal data if we obtain personal data via a third party;

h) the existence of automated decision-making.

If we cannot provide you with access to your personal data (for example due to legal obligations), we will let you know why this is not possible.

You can also obtain a free copy of the processed personal data in an intelligible form. Please note that we may charge a reasonable fee to cover our administrative costs for each additional copy you request.

 

II. Right to erasure (“right to be forgotten") (Art. 17 GDPR)

In certain cases, you can ask us to erase your personal data. Please note that your right to be forgotten is not absolute. We have the right to continue to retain your personal data where this is, among other things, necessary for performance of the contract, compliance with a legal obligation, or for the establishment, exercise or defense of legal claims. We will inform you about this in more detail in our response to your request.

 

III. Right to rectification and completion (Art. 16 GDPR)

If your personal data is inaccurate, outdated or incomplete, you can ask us to correct such inaccuracies or incompleteness.

 

IV. Right to data portability (Art. 20 GDPR)

You also have the right, under certain conditions, to obtain that we transfer the personal data you have provided to us for performance of the contract or for which you have given consent, to another data controller. Where technically feasible, we will transfer your personal data directly to the new controller.

 

V. Right to restriction of processing (Art. 18 GDPR)

If one of the following situations applies, you can ask us to restrict the processing of your personal data:

a) you contest the accuracy of the personal data (in which case its use will be restricted for a period enabling us to verify the accuracy of the personal data);

b) the processing of your personal data is unlawful;

c) we no longer need your personal data for the purposes of the original processing, but you need it for the establishment, exercise or defense of legal claims;

d) pending a decision on the exercise of your right to object to the processing, you can ask us to restrict the use of your personal data.

 

VI. Right to object (Art. 21 GDPR)

On grounds relating to your particular situation, you may object to the processing of your personal data where that processing is based on our legitimate interest or on the performance of a task carried out in the public interest. In that case, we will stop processing your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, or where the processing of personal data relates to the establishment, exercise or defense of legal claims.

 

VII. Right not to be subject to automated decision-making (Art. 22 GDPR)

You have the right not to be subject to a decision based solely on automated processing that significantly affects you or produces legal effects, and that is taken without meaningful human involvement.

You cannot invoke this right in three situations:

a) where a law permits it (for example, to prevent tax fraud);

b) where the decision is based on the explicit consent of the data subject; or

c) where it is necessary for entering into or performing a contract (note that in that case we always assess, case by case, whether there are less privacy-intrusive methods to conclude or perform the contract).

When your personal data is processed on the basis of your consent, you can withdraw that consent at any time by means of a simple request.

8. Retention of your personal data

We retain your personal data for as long as necessary to achieve the purpose for which it was collected. You should be aware that many (legal) retention periods require the retention of personal data. Where there is no retention obligation, data is systematically deleted as soon as the purpose for which it was collected has been achieved.

In addition, we may retain personal data if you have given us consent to do so (for example, as part of a recruitment procedure) or if we need the data for legal proceedings. In some cases, our employees and staff may be assisted in their work by external service providers. With regard to data protection, an agreement has been concluded with all these service providers to ensure that they manage your personal data in a secure, respectful and careful manner.

In particular, we may share your personal data with the following categories of recipients:

  • We may use carefully selected third parties to provide services on our behalf or to help us provide services to you. We may, for example, engage cloud service providers, IT service providers and other third parties to provide legal, accounting, insurance, audit and other professional services;

We have taken all reasonable and appropriate technical and organizational security measures to protect your personal data as much as possible against accidental or intentional manipulation, loss, destruction or access by unauthorized persons.

The security of your personal data also depends on you. Where we have given you a password (or where you have chosen a password yourself) to access certain parts of our website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
